Why should I consider making a will?

It is important to ensure that your estate is distributed one day in accordance with your wishes. The only way to ensure that your estate is distributed to your desired beneficiaries is by making a valid will.

If you do not make a valid will, your estate may be divided and distributed in accordance with South Australian laws. This process is called Letters of Administration. Not making a valid will can make it more difficult for your family to know exactly who is to administer and benefit from your estate. It may mean that your estate is distributed to people not of your choosing or in a way that is not suitable.

Our experienced legal team can help you to identify the most appropriate way for your estate to be planned. We can meet with you at our office or your home to take your instructions prior to preparing your estate planning documents.

Should I also make an Enduring Power of Attorney?

An enduring power of attorney (EPOA) is a important and useful legal document that allows you to appoint a person to manage your financial and legal affairs. This document can be relied on if you become unable to make legal decisions for yourself due to illness, injury or other circumstances.

An EPOA is a specific type of power of attorney that continues to be valid even if you lose mental capacity.

We do not often like to think about whether we will ever be in circumstances in which we cannot make decisions for ourselves after being seriously injured or incapacitated. While it is not always easy to think about, it is extremely beneficial to plan for any circumstance.

What can my Enduring Power of Attorney do?

An EPOA gives your appointed person the authority to make decisions and take actions on your behalf, such as managing your bank accounts, paying bills, buying or selling property and making legal decisions. You can specify the scope of the appointed person’s powers.

It is important to appoint a person who you trust to act in your best interests and who has the skills and knowledge necessary to manage your affairs. We can advise you in relation to your specific circumstances to assist you in choosing the most appropriate person.

An EPOA is an important legal document. Having our team assist you ensures that your EPOA is legally binding and meets your specific needs.

Did you know?

In South Australia, you can leave your digital assets, such as social media accounts or cryptocurrency, to someone in your will! South Australia's laws allow for digital assets to be part of your estate, so you can ensure your online presence is managed according to your wishes after you pass away. You can even specify who will be responsible for handling your digital accounts.
